1. Scope

This notice supplements our Privacy Policy and applies solely to consumers who reside in the State of California. It is provided under the California Consumer Privacy Act of 2018 as amended by the California Privacy Rights Act of 2020 (together, the “CCPA”).

Terms defined in the CCPA have the same meaning when used in this notice. AGENCY 54, LLC is the “business” for the purposes of the CCPA.

2. Categories of personal information collected

In the preceding twelve months we have collected the following categories of personal information, in each case for the business purposes described in our Privacy Policy:

3. Sources of personal information

We obtain personal information from:

  • You, directly — by telephone, email, text message or website form
  • Automatically — through server logs and cookies when you visit our website
  • Carriers and reservation systems — booking confirmations, ticket numbers and status updates relating to your reservation
  • Payment processors — transaction authorisation results (never full card numbers)

4. Business purposes for collection

We use personal information for the following CCPA business purposes:

  • Performing services requested by you, including booking, ticketing and customer support
  • Processing payments and maintaining transaction records
  • Providing customer service and responding to enquiries
  • Detecting and preventing security incidents, fraud and unlawful activity
  • Debugging and repairing errors in our systems
  • Complying with legal obligations, including tax and consumer-protection record keeping
  • Internal quality assurance and staff training
  • Marketing communications, only where you have given express prior consent

5. Disclosure of personal information

In the preceding twelve months we disclosed categories A, B, C, D and L to rail carriers and reservation systems for the business purpose of creating and servicing reservations you requested, and categories A, B and D to service providers (payment processing, hosting, email delivery and telephony) acting on our behalf under written contract.

We have not sold or shared personal information in the preceding twelve months, and we do not sell or share the personal information of consumers under 16 years of age.

6. Sensitive personal information

Where you volunteer information about a disability or mobility requirement so that we can arrange assistance, we use it solely for that purpose. We do not use or disclose sensitive personal information for the purpose of inferring characteristics about you, and we do not use it for any purpose beyond those permitted by CCPA §1798.121(a).

You may nonetheless direct us to limit our use of sensitive personal information by contacting us; note that doing so may prevent us from arranging the assistance you require.

7. Your California rights

As a California resident you have the right to:

  1. Know — the categories and specific pieces of personal information we have collected, the sources, the business purposes and the categories of recipients
  2. Delete — request deletion of personal information, subject to statutory exceptions including our legal record-keeping obligations
  3. Correct — request correction of inaccurate personal information
  4. Opt out — of sale or sharing of personal information (we do not engage in either)
  5. Limit — the use and disclosure of sensitive personal information
  6. Portability — receive a copy in a readily usable, machine-readable format
  7. Non-discrimination — not be discriminated against for exercising any of these rights

8. How to submit a request

We will verify your identity before responding to a request to know, delete or correct, by matching the information you provide against information in our records. For requests concerning specific pieces of personal information, we apply a higher standard of verification.

We will confirm receipt within 10 business days and respond substantively within 45 calendar days, extendable once by a further 45 days where reasonably necessary, with notice to you. Requests are free unless manifestly unfounded or excessive.

9. Shine the Light

California Civil Code §1798.83 permits California residents to request information about disclosure of personal information to third parties for those parties' direct marketing purposes. We do not make such disclosures.

10. Minors

California Business and Professions Code §22581 permits California residents under 18 who are registered users to request removal of content they have publicly posted. We do not host user-generated content, so this provision does not apply in practice; nonetheless, contact us if you believe it does and we will assist.
