1. Agreement to these terms

These Terms and Conditions ("Terms") form a legally binding agreement between you and AGENCY 54, LLC, a Florida limited liability company trading as Skyward Bookings, with its principal place of business at 927 Tan Tara TRL, Jacksonville, FL 32221.

By accessing this website, contacting us by telephone or email, or requesting or purchasing any service from us, you agree to be bound by these Terms, our Privacy Policy, our Refund & Cancellation Policy and our Disclaimer, each of which is incorporated here by reference.

If you do not agree to these Terms, do not use this website or our services.

2. Who we are — and who we are not

Skyward Bookings is an independent travel agency. We are not Amtrak, VIA Rail Canada, Eurostar, National Rail, Network Rail, Brightline, or any train operating company. We are not affiliated with, endorsed by, sponsored by, licensed by or acting as an agent of any rail carrier, transport authority or government agency.

We act as an intermediary. We arrange travel services that are supplied by independent third-party carriers. Those carriers are the principals to your transportation contract, and their own conditions of carriage, tariffs and terms govern the transportation itself.

All carrier names, route names, train names, trademarks, service marks and logos appearing on this website are the property of their respective owners and are used solely for identification and descriptive purposes under nominative fair use.

3. Our services

We provide the following services:

  • Searching live availability and fares across rail carriers in the United States, Canada and the United Kingdom
  • Constructing, quoting and comparing itineraries, including alternative fare constructions
  • Making, amending and cancelling reservations with carriers on your behalf and at your instruction
  • Collecting payment of carrier fares and our service fee
  • Issuing travel documentation supplied by or on behalf of carriers
  • Arranging accessibility assistance and special requests with carriers
  • Providing post-booking support, including rebooking assistance during disruption

4. Service fees

We charge a per-passenger service fee for our work. This fee is in addition to the fare charged by the carrier. We do not mark up the carrier's fare.

Our service fee is quoted to you verbally before any payment is authorised, and is itemised separately on your written confirmation. If you do not wish to pay the fee, you may end the call at no cost and no charge will be made.

Service fees are earned when we complete the booking work and are separately governed by our Refund & Cancellation Policy.

5. Prices, availability and accuracy

All fares, schedules, availability and terms are set by the carriers, are subject to change without notice, and are not guaranteed until a reservation is confirmed and ticketed. A quotation does not constitute a reservation.

We use reasonable efforts to ensure that information on this website is accurate at the time of publication. Route descriptions, journey times, station details, equipment types, onboard amenities and policies change frequently and without notice to us. Content on this site is provided for general informational purposes only and does not form part of any contract.

In the event of an obvious pricing or availability error, we reserve the right to correct the error and to cancel any booking made on the basis of it, refunding any amounts paid in full.

6. Your obligations

You agree that you will:

  • Provide accurate, complete and current information, including the legal name of every traveler exactly as it appears on their identification
  • Review your written confirmation immediately and notify us of any error within 24 hours of receipt
  • Obtain and carry all documentation required for your journey, including passports and visas for cross-border travel
  • Comply with the conditions of carriage and rules of every carrier you travel with
  • Arrive at stations with sufficient time to board, allowing for queues and ticket barriers
  • Be at least 18 years of age and legally capable of entering into a binding contract
  • Use the website only for lawful purposes and not attempt to interfere with its operation, scrape its content, or gain unauthorised access to any system

7. Payment

We accept major credit and debit cards. Payment is processed through a PCI-DSS compliant payment gateway. By providing payment details you represent that you are authorised to use the payment method and authorise us to charge the total amount quoted, including the carrier fare and our service fee.

Charges may appear on your statement as separate line items for the carrier fare and our service fee, or as a single combined amount, depending on the carrier and the ticketing method used.

Chargebacks initiated without first contacting us to resolve the matter may result in recovery of costs and suspension of service.

8. Changes, cancellations and refunds

Whether a booking can be changed or refunded is determined entirely by the fare rules of the ticket purchased, which are set by the carrier. We explain those rules to you before payment.

Our service fee is separately governed by our Refund & Cancellation Policy. Please read it before booking.

Where a carrier cancels or significantly delays a service, we will assist you in rebooking and in pursuing any compensation the carrier owes you under its own policies or applicable passenger-rights rules. We do not guarantee any particular outcome, and we are not liable for the carrier's decisions.

9. Disclaimer of warranties

THIS WEBSITE AND OUR SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

We do not warrant that the website will be uninterrupted, secure or error-free, that defects will be corrected, or that the site or its servers are free of harmful components. We make no warranty regarding the performance, conduct, acts or omissions of any carrier or other third-party supplier.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AGENCY 54, LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF ENJOYMENT, LOSS OF DATA OR COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATING TO YOUR USE OF THIS WEBSITE OR OUR SERVICES, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO OUR SERVICES EXCEED THE TOTAL SERVICE FEES YOU PAID TO US FOR THE BOOKING GIVING RISE TO THE CLAIM.

We are not liable for the acts, errors, omissions, representations, warranties, breaches, negligence or delays of any carrier or third-party supplier, nor for personal injury, death, property damage or other loss arising from them. We are not liable for events beyond our reasonable control, including weather, natural disaster, strike, labour dispute, mechanical failure, government action, civil disturbance, terrorism, epidemic, or carrier insolvency.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot lawfully be limited.

11. Indemnification

You agree to indemnify, defend and hold harmless AGENCY 54, LLC and its members, officers, employees and agents from any claim, demand, loss, liability, damage, cost or expense, including reasonable attorneys' fees, arising out of or relating to your breach of these Terms, your violation of any law or the rights of a third party, or information you provide to us that is inaccurate or incomplete.

12. Intellectual property

All content on this website — including text, route guides, station guides, editorial commentary, design, graphics, layout, code and the Skyward Bookings name and logo — is owned by or licensed to AGENCY 54, LLC and is protected by United States and international copyright and trademark law.

You may view and print pages for your own personal, non-commercial use. You may not reproduce, republish, distribute, sell, licence, scrape, systematically extract or create derivative works from any part of this website without our prior written permission.

Notices of alleged copyright infringement should be submitted in accordance with our Copyright & DMCA Policy.

13. Communications and recording

By providing your telephone number you consent to receive calls and text messages from us relating to your enquiry or booking, including by automated technology. Consent to marketing communications is not a condition of purchase and may be withdrawn at any time. See our SMS Terms.

Calls to and from our reservations desk may be recorded or monitored for training, quality assurance and dispute-resolution purposes. Where recording occurs you will be notified at the start of the call, and you may ask that the call not be recorded.

14. Dispute resolution and governing law

These Terms are governed by the laws of the State of Florida, United States of America, without regard to conflict-of-law principles.

Before commencing any formal proceeding, you agree to contact us and attempt in good faith to resolve the dispute informally for a period of at least 30 days.

Any dispute not resolved informally shall be brought exclusively in the state or federal courts located in Duval County, Florida, and you consent to the personal jurisdiction of those courts. You and we each waive any right to a trial by jury and agree that claims may be brought only in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

Nothing in this section prevents either party from seeking relief in a small-claims court of competent jurisdiction.

15. General provisions

Entire agreement. These Terms, together with the policies incorporated by reference, constitute the entire agreement between you and us regarding our services.

Severability. If any provision is held unenforceable, that provision shall be limited or severed to the minimum extent necessary and the remaining provisions shall remain in full force.

No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.

Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition or sale of assets.

Changes. We may revise these Terms at any time by posting an updated version. Changes apply prospectively from the date of posting and do not alter the terms applicable to bookings already confirmed.
